Terms of Service

These terms form the contract between you and Klarcloud when you order a server.
1. Who we are

2. Contract formation
A contract is formed when we confirm your order by email after successful payment. You must be at least 18 years old and have legal capacity to contract. Business customers act in a professional capacity and consumer-specific rights below do not apply to them.
3. Services
We provide virtual private servers with the resources described on the plan you ordered, in the datacentre location you selected. Resources are dedicated as stated; network capacity is shared and subject to fair use. We may change hardware or upstream providers as long as the specification you paid for is maintained or improved.
4. Prices, VAT and payment
Prices are shown in USD or EUR. Consumers in the EU are charged VAT at their country's rate; business customers with a VAT ID validated against VIES are reverse-charged at 0%. Customers outside the EU are not charged EU VAT. Payment is taken in advance for the billing period through our payment partner.
Optional tips are voluntary, are billed as a separate line, and are non-refundable.
5. Renewals and cancellation
Services renew automatically at the end of each billing period at the then-current price. You may cancel at any time from the client area or by email; cancellation takes effect at the end of the paid period, and the server and its data are deleted seven days later.
6. Your responsibilities
You are responsible for everything that runs on your server, for keeping it patched, for your own backups, and for compliance with our Acceptable Use Policy and all applicable law. Keep your account credentials secret.
7. Suspension and termination
We may suspend a service without notice where it endangers our network or other customers, is the source of attacks or spam, or is the subject of a valid legal order. Otherwise we give notice and a reasonable chance to fix the problem. Unpaid invoices lead to suspension after seven days and deletion after 14 days.
8. Availability
Availability commitments and credits are set out in our Service Level Agreement. Planned maintenance is announced at least 48 hours in advance where possible.
9. Liability
We are liable without limit for intent, gross negligence, and injury to life, body or health, and under mandatory statutory rules. For slight negligence we are liable only for breach of an essential contractual obligation, limited to foreseeable damage typical for this type of contract and in any case capped at the fees you paid in the 12 months before the event. We are not liable for loss of data where you did not maintain your own backups.
10. Right of withdrawal (consumers)
Consumers in the EU have a 14-day right of withdrawal. This right is waived once the server is provisioned at the customer's express request.
11. Changes to these terms
We may amend these terms with 30 days' notice by email. If you object, you may terminate before the change takes effect and receive a pro-rata refund of prepaid fees.
12. Governing law
Polish law. Consumers resident in the European Union keep the mandatory consumer protections of their home country.
